GENERAL TERMS AND CONDITIONS OF SALE
1. Scope of application
These General Terms and Conditions of Sale (the “General Terms”) apply to any purchase of goods or products (the “Products”) made through www.gigistudios.com/en(the “Website”), owned by OFFVIEW, S.L., with registered office at Calle Bosc Tancat n.º 8, Nave 4, 08290 Cerdanyola del Vallès (Barcelona), and Tax Identification Number B72903537.
OFFVIEW, S.L. may amend these General Terms. The version in force at the time the Customer places the order shall apply. Customers are therefore advised to consult them before each purchase.
2. Orders
2.1 How to place an order
• The Customer may register as a user or purchase as a guest, when this option is available.
• The Customer shall select the Products, which will be added to the cart, and provide the data necessary to process and deliver the order: full name, complete address, email address and contact telephone number.
• Before confirming the order, the Customer may review and correct the data, apply valid discount codes and consult the order summary, taxes and shipping costs.
• The purchase shall be formalised by clicking the button that unequivocally indicates a payment obligation, after accepting these General Terms.
Personal data shall be processed in accordance with the Privacy Policy. Any errors in the data or in the order must be reported as soon as possible to clientexperience@gigistudios.com or to +34 936 915 450. Any requested modification will depend on the status of preparation or shipment.
2.2 Availability
All orders are subject to availability. If a Product is not available after the order has been confirmed, OFFVIEW, S.L. shall inform the Customer and refund the amounts paid for that Product using the same means of payment, unless otherwise expressly agreed.
2.3 Force majeure
OFFVIEW, S.L. shall not be liable for delays or non-performance caused by events beyond its reasonable control that qualify as force majeure under applicable law. This is without prejudice to the mandatory rights of the consumer.
3. Price, taxes and payment
3.1 Price and taxes
Prices are displayed in euros and include VAT and other applicable taxes. The price shown and accepted at the time of purchase shall apply to the order. Subsequent changes shall not affect already confirmed orders.
Shipping costs are not included in the Product price unless expressly indicated. They are calculated according to the destination, the available shipping method and, where applicable, applicable promotions, and are shown separately before payment is confirmed.
3.2 Payment via Shopify Payments
Card payments are processed through Shopify Payments and the payment service providers integrated into Shopify, in accordance with their applicable security measures and standards. OFFVIEW, S.L. does not store complete card data directly.
The Customer may use the cards and other means of payment shown as available at checkout, including PayPal when enabled. Each means of payment may be subject to its own terms and conditions.
3.3 Confirmation and invoice
OFFVIEW, S.L. shall send an order confirmation to the email address provided. The invoice or receipt shall be provided in accordance with applicable regulations and, where appropriate, an electronic invoice may be requested.
4. Shipping
4.1 Delivery and tracking
Delivery occurs when the Customer, or a third party indicated by the Customer other than the carrier, takes physical possession of the Products. Deliveries are not made to post office boxes.
Orders are processed Monday to Thursday from 8:00 a.m. to 5:30 p.m. and Fridays from 8:00 a.m. to 4:00 p.m., excluding public holidays. As a general rule, they are prepared within 24 business hours after payment confirmation.
• European Union: estimated delivery time of 2 to 4 business days.
• Rest of the world: estimated delivery time of 6 to 8 business days, subject to possible customs formalities.
Delivery times are estimates and may vary depending on the destination or circumstances beyond the control of OFFVIEW, S.L. When the order is shipped, the Customer will receive the available tracking information. If the estimated delivery time cannot be met, the Customer will be informed and the legally applicable remedies will be offered.
4.2 Shipping costs by destination
Shipping costs are determined according to the country or territory of destination. A free option may be available for certain destinations, with different rates for others. The applicable rate and available options are shown at checkout before the Customer becomes obliged to pay.
4.3 Customs and duties
Orders shipped to countries within the European Union are processed with taxes included where required or permitted by applicable regulations. For shipments outside the European Union, the recipient may be liable for customs duties, import taxes and customs handling fees. Unless legally required, these amounts are not refundable by OFFVIEW, S.L.
5. Legal guarantee of conformity
The Products are subject to the legal guarantee provided for in Royal Legislative Decree 1/2007 and other applicable regulations. For new goods purchased by consumers, OFFVIEW, S.L. shall be liable for any lack of conformity existing at the time of delivery that becomes apparent within the legal period of three years.
Where a Product is not in conformity, the consumer shall be entitled, under the terms of the law, to its repair or replacement and, where appropriate, to a proportional reduction of the price or to the termination of the contract. Bringing the Product into conformity shall be free of charge, within a reasonable time and without significant inconvenience.
The guarantee does not cover normal wear and tear or damage attributable to improper use, failure to follow instructions, impacts, falls, water, fire, improper storage or unauthorised repairs, provided that these do not legally constitute a lack of conformity.
For Products purchased directly on the Website: clientexperience@gigistudios.com or +34 936 915 450. For prescription glasses purchased in an optical store, the Customer must contact the establishment where the purchase was made.
6. Legal right of withdrawal
The consumer may withdraw without giving any reason within 14 calendar days from the day on which the consumer, or a third party indicated by the consumer other than the carrier, receives the Product. If the Products of an order are delivered separately, the period begins upon receipt of the last Product.
To exercise this right, the consumer must communicate an unequivocal decision before the expiry of the period to OFFVIEW, S.L., Calle Bosc Tancat n.º 8, Nave 4, 08290 Cerdanyola del Vallès (Barcelona), Spain, or to clientexperience@gigistudios.com. The communication may include the order number, Products, dates, name, address and, only if submitted on paper, a signature.
6.1 Exceptions
The right of withdrawal does not apply in the cases provided for by law, including, among others, goods made to the consumer’s specifications or clearly personalised; goods that may deteriorate or expire rapidly; sealed goods that are not suitable for return for reasons of health or hygiene once unsealed; and the other cases set out in Article 103 of Royal Legislative Decree 1/2007.
6.2 Effects
In the event of a valid withdrawal, OFFVIEW, S.L. shall refund the payments received, including the costs of the least expensive ordinary delivery method offered, within 14 calendar days from the communication. It may withhold the refund until it has received the Products or proof of their return, whichever occurs first.
The refund shall be made using the same means of payment, unless otherwise expressly agreed without additional cost. The consumer shall return the Products within 14 days following the communication and shall bear the direct costs of return unless OFFVIEW, S.L. has agreed to bear them or is legally required to do so. The consumer shall only be liable for any diminished value of the Products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Products.
7. Commercial 30-day return policy
Without limiting the legal right of withdrawal, GIGI STUDIOS offers a commercial return policy of 30 days from the date of purchase, subject to the conditions published on the Shipping and Returns page.
The request must be made from the email used for the purchase, indicating the order number and the Products. When a gift card is chosen, the return will be free of charge according to the published policy. When a refund to the original means of payment is requested, the return cost will depend on the destination and will be deducted or charged as indicated during the process. This commercial policy does not reduce the consumer’s legal rights.

8. Intellectual and industrial property
The contents of the Website are owned by OFFVIEW, S.L. or by authorised third parties. Access does not imply any waiver, transfer or licence. Their reproduction, modification, distribution, public communication or exploitation outside the cases legally permitted without authorisation is prohibited.
9. Language
These General Terms may be published in several languages. In the event of any discrepancy in interpretation, the Spanish version shall prevail, without prejudice to the mandatory rules applicable to the consumer in their country of residence.
10. Alternative dispute resolution
The former European Online Dispute Resolution Platform ceased to be operational on 20 July 2025. Consumers in the European Union may obtain information on alternative dispute resolution bodies and mechanisms through the national authorities and the European Commission, without prejudice to their right to go to court.
11. Applicable law and jurisdiction
These General Terms are governed by Spanish law, without prejudice to the mandatory consumer protection rules that may apply. Consumers may bring proceedings before the competent courts in accordance with the law, without waiving any legal jurisdiction to which they are entitled. For non-consumer Customers, where it is valid to agree, the parties submit to the Courts and Tribunals of Barcelona.
12. Personal data
Personal data shall be processed in accordance with Regulation (EU) 2016/679, Organic Law 3/2018 and other applicable regulations, for the purposes and under the conditions described in the Privacy Policy.
