GENERAL TERMS AND CONDITIONS OF SALE

1. Scope

These General Terms and Conditions of Sale (the “Terms”) apply to any purchase of goods or products (the “Products”) made through www.gigistudios.com (the “Website”), owned by OFFVIEW, S.L., with registered office at Calle Bosc Tancat no. 8, Unit 4, 08290 Cerdanyola del Vallès (Barcelona), Spain, tax identification number B72903537.

OFFVIEW, S.L. may amend these Terms. The version in force when the Customer places the order will apply; Customers are therefore advised to review them before each purchase.

2. Orders

2.1 How to place an order

• The Customer may register for an account or check out as a guest, where this option is available.

• The Customer selects the Products, which are added to the cart, and provides the information required to process and deliver the order: full name, complete address, email address and telephone number.

• Before confirming the order, the Customer may review and correct the information, apply valid discount codes and view the purchase summary, taxes and shipping charges.

• The purchase is concluded when the Customer clicks the button that clearly indicates an obligation to pay, after accepting these Terms.

Personal data are processed under the Privacy Policy. Errors in personal or order details should be reported promptly to clientexperience@gigistudios.com or +34 936 915 450. Any requested change will depend on the order’s preparation or shipping status.

2.2 Availability

All orders are subject to availability. If a Product becomes unavailable after confirmation, OFFVIEW, S.L. will notify the Customer and refund the amounts paid for that Product using the original payment method, unless expressly agreed otherwise.

2.3 Force majeure

OFFVIEW, S.L. is not liable for delays or failures caused by events beyond its reasonable control that legally constitute force majeure. This does not affect any mandatory consumer rights.

3. Price, taxes and payment

3.1 Price and taxes

Prices are shown in euros and include VAT and other taxes where applicable. The price displayed and accepted at the time of purchase applies. Later price changes do not affect confirmed orders.

Shipping charges are not included in the Product price unless expressly stated. They are calculated according to the destination, available shipping method and any applicable promotion, and are shown separately before payment is confirmed.

3.2 Payment through Shopify Payments

Card payments are processed through Shopify Payments and payment service providers integrated with Shopify, in accordance with their applicable security measures and standards. OFFVIEW, S.L. does not directly store complete card details.

The Customer may use the cards and other payment methods displayed as available at checkout, including PayPal where enabled. Each method may be subject to its own terms.

3.3 Confirmation and invoice

OFFVIEW, S.L. sends an order confirmation to the email address supplied. The invoice or receipt is provided as required by applicable law and, where appropriate, an electronic invoice may be requested.

4. Shipping

4.1 Delivery and tracking

Delivery occurs when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products. Deliveries cannot be made to PO boxes.

Orders are processed Monday to Thursday from 8:00 a.m. to 5:30 p.m. and Friday from 8:00 a.m. to 4:00 p.m., excluding public holidays. As a general rule, they are prepared within 24 business hours after payment confirmation.

• European Union: estimated delivery in 2–4 business days.

• Other countries: estimated delivery in 6–8 business days, subject to customs formalities.

Delivery times are estimates and may vary by destination or due to circumstances beyond OFFVIEW, S.L.’s control. Tracking information is sent when available. If the expected delivery period cannot be met, the Customer will be informed and offered the remedies required by law.

4.2 Destination-based shipping charges

Shipping charges depend on the destination country or territory. A free option may be available for certain destinations, with different rates applying elsewhere. The applicable rate and available options are displayed at checkout before the Customer becomes bound to pay.

4.3 Customs duties and import charges

Orders sent to European Union countries are handled with taxes included where required or permitted by applicable law. For shipments outside the European Union, the recipient may be responsible for customs duties, import taxes and clearance fees. Unless required by law, OFFVIEW, S.L. does not refund these amounts.

5. Statutory conformity guarantee

Products are covered by the statutory conformity guarantee under Spanish Royal Legislative Decree 1/2007 and other applicable consumer law. For new goods purchased by consumers, OFFVIEW, S.L. is liable for non-conformities existing on delivery that become apparent within the statutory period of three years.

For a non-conforming Product, the consumer is entitled, under the applicable rules, to repair or replacement and, where the legal conditions are met, to a proportionate price reduction or termination of the contract. Bringing the Product into conformity will be free of charge, within a reasonable time and without significant inconvenience.

The guarantee does not cover normal wear and tear or damage attributable to misuse, failure to follow care instructions, impacts, falls, water, fire, improper storage or unauthorised repairs, provided such damage does not legally constitute a lack of conformity.

6. Statutory right of withdrawal

A consumer may withdraw without giving a reason within 14 calendar days from the date on which the consumer, or a designated third party other than the carrier, receives the Product. If Products in one order are delivered separately, the period begins on receipt of the last Product.

To exercise this right, the consumer must send an unequivocal statement before the deadline to OFFVIEW, S.L., Calle Bosc Tancat no. 8, Unit 4, 08290 Cerdanyola del Vallès (Barcelona), Spain, or clientexperience@gigistudios.com. The notice may state the order number, Products, dates, name, address and, only for a paper notice, signature.

6.1 Exceptions

Withdrawal does not apply in the cases laid down by law, including goods made to the consumer’s specifications or clearly personalised; goods liable to deteriorate or expire rapidly; sealed goods unsuitable for return for health protection or hygiene reasons once unsealed; and the other cases set out in Article 103 of Spanish Royal Legislative Decree 1/2007.

6.2 Effects

Following a valid withdrawal, OFFVIEW, S.L. refunds all payments received, including the cost of the least expensive standard delivery method offered, within 14 calendar days of being informed. It may withhold reimbursement until it receives the Products or evidence that they have been returned, whichever occurs first.

The refund is made by the original payment method unless another method is expressly agreed without additional cost. The consumer must return the Products within 14 days of the notice and bears the direct return costs unless OFFVIEW, S.L. has agreed, or is legally required, to bear them. The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the Product’s nature, characteristics and functioning.

7. 30-day commercial returns policy

Without limiting the statutory right of withdrawal, GIGI STUDIOS offers a commercial returns policy of 30 days from the purchase date, subject to the conditions published on the Shipping and Returns page.

The request must be sent from the email address used for the purchase and identify the order and Products. If a gift card is selected, the return is free of charge under the published policy. If a refund to the original payment method is requested, the return charge depends on the destination and is deducted or charged as indicated during the process. This commercial policy does not reduce statutory consumer rights.

8. Intellectual and industrial property

Website content is owned by OFFVIEW, S.L. or authorised third parties. Access does not imply any waiver, transfer or licence. Reproduction, modification, distribution, public communication or exploitation beyond uses permitted by law is prohibited without prior authorisation.

9. Language

These Terms may be published in several languages. In the event of an interpretative discrepancy, the Spanish version serves as the reference, without prejudice to mandatory consumer rules applicable in the consumer’s country of residence.

10. Alternative dispute resolution

The former European Online Dispute Resolution Platform ceased operating on 20 July 2025. EU consumers may obtain information about alternative dispute resolution bodies and mechanisms from national authorities and the European Commission, without prejudice to their right to bring proceedings before the courts.

11. Governing law and jurisdiction

These Terms are governed by Spanish law, without prejudice to mandatory consumer-protection rules. Consumers may bring disputes before the courts having jurisdiction under applicable law and do not waive any statutory venue. For non-consumer Customers, where a jurisdiction agreement is valid, the parties submit to the courts of Barcelona.

12. Personal data

Personal data are processed under Regulation (EU) 2016/679, Spanish Organic Law 3/2018 and other applicable rules, for the purposes and under the conditions described in the Privacy Policy.
